Terms of use
The rules for using Sivamo, for groups of friends and for organizers. Please read them: by using Sivamo you agree to them.
This text is a draft. It may change before it is final.
Who you agree with
These terms are an agreement between you and Appy Solutions EOOD, a single-member limited liability company registered in Bulgaria under EIK 206612061, with its registered office at ul. Ivan Susanin 45, vh. A, Sofia 1618, Bulgaria (“we”), which operates Sivamo. All our details are in the Legal notice.
By creating an account, joining a group, asking for a seat or publishing a departure, you agree to these terms. How we use your data is in the Privacy policy, and the cookies are in the Cookie policy.
How the contract is made
- The account. You sign in with a code sent to your email or by text message, or with Google, Apple or Facebook. The first time you sign in, we create your account, and the contract for the free use of Sivamo starts.
- A paid plan or AI credits. You choose them in the app and pay on Stripe's payment page. Before you pay, the page shows what you buy, the price with VAT and, for a plan, how often it renews; until you press pay, you can go back and change anything. The contract is made when the payment is confirmed. We send you a receipt by email.
- A seat on a departure. That contract is between you and the organizer, not with us (see below).
- The contract is in English or Romanian, the language you use Sivamo in. We keep these terms on this page, with the date of each version; save or print it if you want a copy. We don't follow a separate code of conduct.
What Sivamo is, and what it isn't
Sivamo is a tool: groups of friends decide, plan and live a trip together, and organizers (agencies, tour operators, clubs, guides) publish departures, take requests and payments and write to their participants.
Sivamo is not a travel agency or a tour operator. We don't sell, organize or provide trips, and we are not a party to the travel contract. When you book a seat on a departure, the contract is between you and the organizer named on the departure page. The organizer is responsible for the trip, its price and terms, the licences and the insolvency protection it must have, and the information the law requires before you book. Your rights under travel and consumer law are against the organizer.
Bookings you make elsewhere, for example from a link in a group (a hotel, a flight, an activity), are between you and that provider.
Organizers' departures: who sells and how they are listed
- Who sells. Each departure is offered by the organizer named on its page. The page shows the organizer's name, its legal name when it is different, its tourism licence when it has one, and how to reach it. The organizer's own terms, when it has them, are on the same page. The page also says whether the organizer is a Professional organizer (a trader) or a Non-professional organizer, as the organizer declared it in its profile.
- When the organizer is not a firm. Some organizers are clubs or private people who don't act as a business. The EU consumer protection rules (for example the right of withdrawal or the package travel rules) apply only against a trader. Against an organizer who is not a trader, you don't have those rights; you have only what you agree with it and the general law.
- How departures are listed. On an organizer's page, its upcoming public departures are listed by start date, the earliest first, and, on the same date, by when they were published. In a group of friends, “Trips with free seats” shows public departures that match the group's countries, dates and theme, and still have free seats, by start date. No one can pay to be listed higher. If that ever changes, we say it here and mark the paid places.
- Who is responsible for what. The organizer answers for the trip, its page, its price and terms, and for cancellations and refunds. We answer for Sivamo working, for handling reports and for what we promise in these terms. Payments go straight to the organizer, through Stripe.
Your account
- You must be at least 16 to create an account.
- Give accurate details and keep them up to date. One account is for one person.
- Keep access to your email (and phone) safe: sign-in codes are sent there. Tell us if you think someone else is using your account.
- You are responsible for what is done from your account.
Groups
The owner of a group decides who is in it, the roles and what members can do. What you write in a group stays visible to the group.
For organizers
If you publish departures, the Terms for organizers apply too. In short: you sell the trip and you answer for it, you have the licences and the insolvency protection your law asks for, your pages are accurate, and you use participants' data only to run the trip.
Payments and fees
- Travellers pay organizers by card, through Stripe, straight into the organizer's own Stripe account.
- Sivamo keeps a fee from each online payment to an organizer, as shown on the Pricing page. The traveller pays the price on the departure page.
- Refunds of a trip are decided and made by the organizer.
- Prices may change; a change applies from the next period, and we tell you before it does.
Plans and AI credits
- Basic and Plus are paid plans for your account, for 6 months or a year, with VAT included. The groups you own get their features.
- Renewal. A plan renews by itself at the end of each period, at the price shown when you bought it or at the new price we told you about in advance.
- How to stop it. In the app, open the account menu, then the plan, and press cancel. The plan doesn't renew; you keep it until the end of the period you paid for.
- At the end. You go back to Free. Your groups and your data stay; only the paid features stop, for example the chat and the group map.
- AI credits are bought once, without a subscription, with VAT included. They last 12 months and are used after the credits included in your account. Credits left after 12 months expire.
- Organizer plans are described in the Terms for organizers.
Your right of withdrawal
If you are a consumer in the EU, you can withdraw from buying a plan or AI credits within 14 days of the purchase, without giving a reason.
- When you pay, you ask us to start the service right away. If you withdraw within the 14 days, the plan stops at once and your groups go back to Free; we refund the part of the plan you haven't used yet, counted by days. A day you've started counts as used.
- The AI credits you haven't used are refunded in proportion to the pack and removed from your balance. The ones you have used are not.
- We refund within 14 days of receiving your withdrawal, to the card you paid with.
How to withdraw. In the app, open the account menu, then the plan, and press Withdraw from the contract here next to the plan or the AI credits. The button is there for the 14 days. The next step shows the contract, the day you bought it and how much you get back; press Confirm withdrawal. We then send you an email that confirms we received your withdrawal, with the date and time, the contract and the amount. The receipt email for a plan or for AI credits has the same link.
You can also write to support@sivamo.app. You can use this text:
“To Appy Solutions EOOD, ul. Ivan Susanin 45, vh. A, Sofia 1618, Bulgaria, support@sivamo.app: I withdraw from the contract for [the Basic or Plus plan / the AI credits] bought on [date]. The email of my account: [email]. My name: [name]. Date: [date].”
A seat on an organizer's departure is not bought from us; the right of withdrawal for it, if any, is in the organizer's terms and the law. For package travel, the law usually doesn't give a 14-day withdrawal, but lets you cancel under the conditions in the contract.
Links that earn us a commission
In groups of friends, when the group picks a stay, a car or an activity, its link, and the matching item in the plan, can earn Sivamo a small commission. The “Before you go” card can also suggest an eSIM or travel insurance. The price you pay stays the same.
- These links don't appear on organizers' departures.
- When you open such a link, we count the click without your personal data and pass you on to the provider.
- Anyone can hide the card, and the group's owner can turn these links off for the group with “Use affiliate links in this group”.
- We never change the order of options or the result of a vote because of a commission.
The AI features
- Some features use AI: importing an offer, ideas for where to go, the plan, summaries and translations. What they make is a suggestion: check prices, opening hours, distances and safety yourself before you rely on it.
- The support assistant in the app is an AI. It answers from our help articles and can be wrong. For something that matters, write to support@sivamo.app: a person answers.
Your content
What you add to Sivamo (messages, photos, offers, departure pages) stays yours. You allow us to host, show, translate automatically and process it, only to run Sivamo for you and for the people you share it with. You are responsible for having the right to post it.
Don't post anything illegal, misleading, hateful or that breaks someone else's rights. Anyone can report a page with Report this page; we check every report, we may remove content or limit an account, and we tell you why. The details, including how to appeal, are in the Content rules.
Fair use
- Don't use Sivamo to send spam, to harass people or to collect their data.
- Don't try to break, overload, scrape or reverse engineer the service, or test its security without our written permission.
- Don't pretend to be someone else, or a firm you don't represent.
Our name and our work
The name Sivamo, the logo, the design, the texts we write and the software belong to us or to those who license them to us. You may use Sivamo as these terms allow, but not copy, sell or rebuild it. The open-source parts keep their own licences, listed in the Legal notice.
Ideas and feedback
If you send us ideas, suggestions or feedback, we may use them to improve Sivamo, without owing you anything for them. You don't have to send them, and we won't publish your name with them without asking you.
Other firms' services
Some parts of Sivamo rely on other firms: Stripe for payments, Google, Apple and Facebook for signing in, map servers, the providers you book with from a link, and your own AI account if you connect one. When you use them, their terms apply too. We are not responsible for what they do on their own pages.
Changes to Sivamo
Sivamo is launching and keeps changing: features can be added, changed or removed. We work to keep it available, but we can't promise it will never be interrupted. If we remove a paid feature you are paying for, we tell you in advance and you can stop the plan, with a refund of the unused part.
Our responsibility
We are not responsible for the trips organizers sell, for what other users or providers do, or for decisions you make based on AI suggestions. If we are responsible for a loss, our liability is limited to what you paid us in the 12 months before it, and to foreseeable losses.
Nothing in these terms limits liability that the law does not allow to be limited, such as for death or personal injury caused by negligence, for fraud, or for gross negligence, and nothing limits the rights you have as a consumer.
Ending
You can stop using Sivamo at any time, and ask us to delete your account at privacy@sivamo.app. We may suspend or close an account that seriously or repeatedly breaks these terms; we tell you why, and you can contest it. Bookings already made stay between you and the organizer.
Complaints
If something went wrong, write to support@sivamo.app and tell us what happened. We answer within 14 days. If you are not happy with the answer, the ways to solve a dispute out of court are in the Legal notice.
Law and disputes
These terms are governed by the law of Bulgaria. If you are a consumer, you keep the protection of the law of the country where you live, and you can bring a claim in its courts. Before going to court, write to us: most problems are solved faster that way.
General terms
- Force majeure. We are not responsible for delays or failures caused by events outside our control, such as a long outage of a provider, a natural disaster or a decision of an authority.
- Transfer. We may transfer this contract to another firm, for example if Sivamo is sold, only if your rights don't get worse. We tell you in advance, and you can end the contract if you don't agree.
- If one clause is invalid, the others still apply.
- Languages. These terms exist in English and Romanian, and both versions are equally valid. If they differ, the one more favourable to you applies.
- Changes to these terms. We tell you by email or in the app before a change applies: at least 30 days before if you have a paid plan (Basic or Plus) or AI credits you bought, and at least 15 days before otherwise, unless the law requires it sooner. If you don't agree, you can end the contract before it applies; a paid plan is then refunded for the unused part.
